# What is a late tender?

A late tender is a bid received after the stated closing date and time of a tender, or only partly received by then. Most public and many private buyers reject late tenders to keep the process fair.

## How late tenders are handled

Tender rules set a closing date and time and usually state that late submissions will not be opened or considered, whatever caused the delay. Some rules allow narrow exceptions, for example when the delay was caused by the buyer or its own system, and the decision must then be recorded. The aim is equal treatment: no bidder should gain time or see information others did not have.

## Common causes of delay on the buyer side

- **Late specifications.**scope of work or terms of reference finished at the last minute, leaving bidders too little time.

- **Late start.**the procurement process begins too close to the need date.

- **Slow opening.**delays in opening and evaluating bids push everything back.

## Why it matters

Accepting a late tender can make the whole award open to challenge by other bidders, especially in public procurement. Clear rules, a reliable submission system and an audit trail of when each bid arrived protect both the buyer and the bidders.

### Can a late tender ever be accepted?
