Contract execution is when all parties sign the final agreed contract, making it binding, and carrying out its obligations begins from the effective date. ## Signs of an executed contract - **Signatures.**Every required party has signed, in ink or by [electronic signature](https://aavenir.com/glossary/e-signature/), through a person with authority to bind the business. - **Effective date.**The date the terms take force, which may be the signature date or a later one. - **Final text.**Negotiation is over, and later changes need a formal amendment. - **Enforceability.**Each party is legally bound, and the signed copy is the record for any dispute. ## What to get right Confirm signing authority before the document goes out, and route it through internal [approval](https://aavenir.com/glossary/contract-approval/) first. Send the executed copy to everyone who needs it and store it where it can be found. Then the real work starts: obligations, milestones, payments and service levels must be tracked against the contract, and any change must be recorded as an amendment rather than an informal agreement. ## How Aavenir handles it [Contractflow](https://aavenir.com/solutions/enterprise-contract-management-software/) sends the approved version for signature, stores the executed copy on the contract record and captures the effective date. [Obligationflow](https://aavenir.com/solutions/contract-obligation-management-software/) then lists the obligations in the signed contract, gives each an owner and a date, and collects evidence that they were met. ## Keep reading [Electronic signature An electronic signature is a way to sign a document electronically to show agreement, recognized in law in most countries, including the United States under the ESIGN Act and the European Union under eIDAS. When all required parties have signed the final agreed version. The terms then bind the parties from the effective date, which can be the signature date or a later date written in the contract. [Read about electronic signatures](https://aavenir.com/glossary/e-signature/). ### ### What is the difference between execution and the effective date? Execution is when the contract is signed. The effective date is when its terms start to apply. They are often the same, but a contract can be signed now and take effect next quarter, or apply back to an earlier date. [See Contractflow](https://aavenir.com/solutions/enterprise-contract-management-software/). ### ### What happens after a contract is executed? The parties perform what they agreed: deliver, pay, meet service levels and report. Tracking those obligations, and recording any change as an amendment, is what turns a signed document into the value it promised. Missed obligations after signature are one of the most common ways contract value leaks away. [See Obligationflow](https://aavenir.com/solutions/contract-obligation-management-software/).
